Terms of sale
Version in force on 20 October 2026
1. Seller
These terms of sale apply to the paid offers of Chess History (the “Service”), sold by FRAMYIA, SAS (French simplified joint-stock company, single shareholder), share capital of €500, registered office 229 rue Saint-Honoré, 75001 Paris, France, Paris Trade and Companies Register 984 789 412, VAT FR60984789412 (“we”). Contact for questions, complaints and legal guarantees: [email protected].
2. Scope
These terms apply to orders placed on the Service by consumers and non-professionals, together with the terms of use. You accept them before paying: the order button (“Get the Pass”) states that continuing means accepting them, and links to them. The applicable version is the one in force on the day of the order.
3. Offers
The Chess History Pass (one-time payment) unlocks all Premium content: every interactive story, including Premium content added after purchase. Access is linked to the buyer’s Account and lasts for as long as the Service is operated, with no subscription or renewal.
One story (one-time payment), where it is offered: unlocks the whole of the interactive story it is bought for (and only that story), on the same terms of access and duration as the Pass. Buying the Pass later is not reduced by the price of stories bought one by one.
The Service runs in an up-to-date web browser (Chrome, Safari, Firefox, Edge) on a computer, tablet or phone, with an internet connection, in English. There is nothing to install, and no technical protection measure limits personal use.
4. Prices
Prices are shown on the order page before payment and include all taxes, in euros for customers in the euro area and in US dollars elsewhere, unless a local currency is stated. As of the date of these terms, the Pass costs €19.99 in the euro area and $19.99 elsewhere, and one story €2.99 or $2.99. Regional prices apply outside the European Union, the EEA and Switzerland, according to the customer’s country (World Bank income data): $9.99 for the Pass and $1.99 for one story in some countries; $4.99 for the Pass in others (one story is not offered there); ₱249 in the Philippines and Rp 69.000 in Indonesia. The country is determined from the connection when the order page opens, and the price shown there is the price charged. Taxes (VAT, sales tax) are charged at the rate of the customer’s country where the law requires it and are included in the price shown; the exact amount appears on the payment page.
5. Ordering
- Choose an offer in the Service and click “Get the Pass”, after reading these terms and the terms of use (linked next to the button), which you accept by continuing.
- On the secure Polar payment page, enter your email address and payment details and check the summary (offer, price including taxes).
- Click the payment button, which constitutes an order with an obligation to pay.
The offer is linked to an Account: your Account if you are signed in; otherwise the Account of the email address entered on the payment page, created at that moment if there is none, and you are then signed in automatically on the device used to pay. On any other device, sign in with that email address (we send it a code).
The order is final once payment is confirmed. A confirmation email is sent on a durable medium, including the offer, the price, a link to these terms and the 30-day money-back guarantee (section 8).
6. Payment
Payment is made online by card or by the other methods shown on the payment page, and is due immediately. Payment data is handled by Polar and its payment processor; we never see it.
The payment is processed by Polar Software, Inc. (United States), acting as reseller (merchant of record): it collects the price, collects and remits the applicable VAT, issues the receipt and handles payment questions, under its terms. Your bank statement shows Polar’s name. FRAMYIA remains responsible for providing the Service, for its conformity and for the money-back guarantee of section 8.
7. Access
Premium content is unlocked on the Account used for the order as soon as payment is confirmed, usually within seconds. If something goes wrong, email [email protected].
8. 30-day money-back guarantee and right of withdrawal
Money-back guarantee. Not happy, for any reason? Email us at [email protected] within 30 days of your purchase, from your Account’s email address or with your order reference. We refund the full amount paid, with no questions asked and no fees, using the same payment method: usually the same day, and in any event within fourteen days. Premium access on your Account ends when the refund is made.
This guarantee comes on top of your legal rights. As a consumer, you also have a right of withdrawal for fourteen days from the conclusion of the contract, without giving reasons (article L. 221-18 of the French Consumer Code). We do not ask you to waive it: you can use it even if you have already accessed the content. To withdraw, send us the form in Appendix 1 or any other clear statement, by email to [email protected] or by post to 229 rue Saint-Honoré, 75001 Paris, France. We will refund all amounts paid within fourteen days of receiving your decision, using the same payment method unless agreed otherwise, at no cost to you.
9. Legal guarantees
FRAMYIA is liable for lack of conformity of the digital content and for hidden defects under articles L. 224-25-1 et seq. of the French Consumer Code and articles 1641 et seq. of the French Civil Code. To use them, contact us using the details in section 1.
The consumer is entitled to the legal guarantee of conformity if a lack of conformity appears during the whole supply period provided for in the contract (for the Pass: as long as the Service is operated), starting from the supply of the digital content or service. During this period, the consumer only has to prove the lack of conformity, not when it appeared.
The legal guarantee of conformity includes the obligation to supply all updates needed to keep the digital content or service in conformity throughout the supply period.
It entitles the consumer to have the digital content or service brought into conformity without undue delay after the request, free of charge and without significant inconvenience.
The consumer may obtain a price reduction while keeping the digital content or service, or end the contract and obtain a full refund in exchange for giving it up, if: (1) the professional refuses to bring it into conformity; (2) bringing it into conformity is unjustifiably delayed; (3) it cannot be brought into conformity without costs imposed on the consumer; (4) bringing it into conformity causes the consumer significant inconvenience; (5) the lack of conformity persists despite the professional’s unsuccessful attempt to fix it.
The consumer is also entitled to a price reduction or to terminate the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination, without first requesting conformity. Where the lack of conformity is minor, the consumer may only terminate the contract if no price was paid. Any period during which the digital content or service is unavailable for the purpose of bringing it into conformity suspends the remaining guarantee period until it is supplied again in conformity.
These rights result from articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code. A professional who obstructs the legal guarantee of conformity in bad faith is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L. 242-18-1). The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect, giving the right to a price reduction if the content is kept or to a full refund in exchange for giving it up.
10. Pass duration and closure of the Service
If we decided to permanently close the Service, we would inform holders of paid offers by email at least three months in advance. If closure occurs less than twenty-four months after a Pass purchase, we will refund its price in proportion to the months remaining in that twenty-four-month period.
11. Liability
We are not liable for force majeure or for the customer’s own acts. This does not limit the legal guarantees in section 9.
12. Complaints
Complaints can be sent to [email protected]. We reply as quickly as possible.
13. Personal data
See the privacy policy.
14. Governing law
These terms are governed by French law, without prejudice to the more protective mandatory rules of the consumer’s country of habitual residence. Disputes go before the competent courts under ordinary rules; consumers may choose the courts of the place where they lived when the contract was concluded.
